If I day trade a 401k IRA account, could I be considerred a day trader by the IRS, although I can not touch?
the money profits til I'm 59 1/2?

How could you propose to day trade with a 401 k IRA? I dont think the question seems right.

i think you can be talking about ETFs exchange traded money which I know nothing about. but you don't get taxed on 401 k or IRA money till you make withdrawals at which time the money you withdrawal will be taxed as common earning. if you withdraw any monies before you reach the era of 59 1/2 there will be an extra 10% excise tax.
